Job Summary

The Maricopa County Community College District (MCCCD) Office of General Counsel has an exciting opportunity for a dedicated and knowledgeable Equal Opportunity & Title IX Program Director to provide regional leadership and support across our 10-college district.

The Equal Opportunity & Title IX Program Director is essential to supporting the Title IX/ Title VI Office and its efforts to ensure compliance with anti-discrimination laws and oversees and coordinates all aspects of Title IX and Title VI compliance, helping ensure a safe, respectful, and equitable environment for students, faculty, and staff. From managing complex investigations and resolving complaints to providing outreach, training, and guidance, this position is a key part in promoting a culture of fairness and accountability.

This role will support and help guide efforts related to protected class discrimination complaints and will collaborate with the Title IX Analyst for Pregnant and Parenting to address nuanced accommodations and service needs, and may also involve coordinating services for pregnant and parenting students.

Additional responsibilities include oversight of regional athletics and scholarship Title IX compliance, contributing to risk assessment and compliance strategies, and collaborating with colleagues across the district as needed.

Essential Functions

40% - Manages and provides oversight for District-wide Title IX and Title VI case management:
  • Responsible for consistent and compliant application of complaint procedures throughout the lifecycle of the complaint, including intake, assignment of any needed supportive measures. (including emergency and interim measures), complaint evaluation, investigation, informal resolution, adjudication, appeal, and implementation of sanctions or remedies.
  • Ensures all complaint processes and investigations are prompt, thorough, effective, and impartial.
  • Provides oversight and guidance to investigators and conducts investigations, as needed, always ensuring investigations are conducted in a timely manner.
  • Ensures that investigation/case management plans are developed and followed for each complaint and that each party is provided a fair and neutral process that complies with all relevant law and policy.
  • Interviews parties and witnesses, ensuring interviews are accurately documented.
  • Identifies, gathers, coordinates, and assesses information and evidence relevant to the investigation, and uses it to prepare comprehensive investigative reports, including exhibits, appendices, and/or supporting materials.
  • Oversees the quality and integrity of all reports and complaint responses.
  • Ensures investigation reports document key steps and decision-making in the investigation, provides parties with appropriate notice and opportunities to review and respond to information collected in the investigation and draft investigative reports, and provides investigative reports and records to the appropriate decision-maker(s).
  • Prepares and/or conducts final reviews of investigation reports and other closing documents, including findings and analysis by investigators, informal resolution facilitators, decision-makers, and appellate decision-makers, and ensures all investigations are concluded with comprehensive and well-documented reports or other documentation.
  • Facilitates collaboration between the investigations team and other departments, as needed, to ensure a coordinated response to incidents.
  • Identifies, recommends, and oversees appropriate action to address and resolve findings of discrimination, harassment, and retaliation.
  • Directs and monitors compliance with record-keeping requirements, including maintaining an up-to-date roster of reports and complaints, informal resolutions, investigations, decisions, recommendations, supportive measures, and other information related to reports and complaints, supervising the maintenance of the electronic and paper filing systems and archiving files when appropriate.
  • Maintains accurate, confidential case documentation using Advocate Symplicity Student Conduct, Title IX, and Behavioral Intervention Management Systems.
  • Stays informed of emerging trends and changes in laws related to civil rights investigations and ensures the District's practices remain current.
  • Identifies and implements improvements in investigative processes and methodologies.

40% - Leads efforts in the region to ensure compliance with statutory and regulatory requirements related to Title IX and Title VI, emphasizing both compliance and education as key priorities:
  • Under the direction of the Title IX Coordinator, develops and provides trainings for Title IX (to include pregnancy & parenting) and Title VI.
  • Develops and delivers outreach materials such as presentations, online modules, and printed guides.
  • Is knowledgeable on trends and updates impacting equity and civil rights both internally and externally, and serves as a partner and advisor to campus leaders to help them maintain current and responsive practices.
  • Works collaboratively with the Title IX Coordinator and others across the Colleges to ensure informed and consistent communication around policy implementation.
  • Identifies and implements measures to promote awareness and understanding of civil rights policies and procedures.
  • Identifies and remediates patterns related to discrimination-based and retaliation, including by reviewing and summarizing data related to reports and complaints, assisting in implementing and coordinating campus climate surveys, assisting in preparing and presenting periodic reports on investigation trends, outcomes, and areas for improvement to leadership and taking action to address concerns when identified.
  • Maintains current knowledge of non-discrimination laws, compliance regulations, agency guidance, due process protections, and other relevant legal issues.
  • Is able to effectively communicate sensitive matters in a variety of modalities and can engage and collaborate with a wide variety of people, including administrators, faculty, staff, students, community partners, and law enforcement.
  • Serves as subject matter expert on compliance requirements and efforts, including maintaining professional qualifications through ongoing training and professional development.

10% - Serves as an expert and resource for the Title IX Analyst (Pregnancy & Parenting) for pregnancy and parenting requests and processing within the assigned areas:
  • Manages complex pregnancy and parenting requests and determines final reasonable accommodations and modifications.
  • Serve as a Deputy Title IX Coordinator for the assigned District region.

10% - Other duties as assigned.

Minimum Qualifications

Master's Degree from a regionally accredited institution in education, educational leadership, or related field, and four (4) years of educational program administration experience that includes two (2) years of case management and investigation.

OR

An equivalent combination of the conferred degree and directly related full-time work experience as described above, sufficient to successfully perform the essential duties of the job, such as those listed above, unless otherwise subject to any other requirements set forth in law or regulation, may be considered.

Desired Qualifications
  • Juris Doctor degree.
  • Title IX Investigator and or EEO investigator training certification.
  • Three (3) years or more of progressively responsible experience in a related field.
  • Three (3) years of experience conducting and supervising investigations alleging harassment and /or discrimination.
  • Three (3) years or more working with Federal and State civil rights and discrimination laws and guidelines, including Title IX, Title VI, Title VII, and the ADA, and demonstrated knowledge of best practices as they relate to higher education compliance with such laws and guidelines.
  • Three (3 )years of experience working in an office that administers equal opportunity, affirmative action, compliance issues, and/or other investigative offices.
  • Three (3) years or more of experience conducting and supervising investigations alleging harassment and /or discrimination, and experience working with Federal and State laws, anti-discrimination laws, regulations and guidelines, and employment laws and practices (Title VII, Title IX, VAWA, the ADA/Section 504, the Age Discrimination Act, the Age Discrimination in Employment Act and other federal and state civil rights laws).


Special Working Conditions
  • The position will be located at MCCCD District office located at 2411 W. 14th Street, Tempe, AZ 85281.
  • The position may be required to travel to colleges, as needed, to fulfill the role.
